DELUXUS S.A.C., located at Calle Pisac 140 - Cooperativa 27 de Abril, Lima - Peru, values the privacy of every individual (referred to as "User" or collectively as "Users") who accesses, browses, uses, or registers on our website (the "Website"). We are particularly concerned about Users who provide their personal data when applying on our Website (referred to as "Applicants").

Any term used in this Privacy Policy that is not defined herein shall be interpreted following the definitions outlined in Law No. 29733, Personal Data Protection Law (hereinafter referred to as the "Personal Data Protection Law").

 

3. Scope of Application

 

This Privacy Policy applies to all Personal Data of Users acquired during navigation, use, or registration on the Website, as well as to all Personal Data provided by Applicants when registering on the Website.

 

4. Consent

 

By accessing, browsing, using, and/or registering on the Website, the User gives their free, express, and informed consent to DELUXUS for the processing of their Personal Data and other actions contemplated in this Privacy Policy. If the User does not agree with the terms of this Policy, they should refrain from using the Website.




5. Automatic Collection of Personal Data

 

Similar to many websites, the server of the Website automatically collects certain personal data from Users, such as their computer's IP address, their Internet service provider's IP address, the date and time of access to the Website, the name and version of their browser, the operating system they are using, the sections of the Website visited, the pages read, and the images viewed, as well as any other content sent or downloaded from the Website. By applying, the User agrees and commits to (a) providing accurate, updated, and complete data about themselves, as required in the application form; and (b) keeping this information updated on the Website to ensure its accuracy and truthfulness. The User will be responsible for the accuracy of the provided data, and DELUXUS reserves the right to exclude any User who has provided false information, without prejudice to taking corresponding legal actions.

 

In order to acquire and/or offer services through the Website, DELUXUS requires the user to apply and provide a series of Personal Data, in accordance with the particular terms and conditions applicable as a user of the Website. In this context, DELUXUS may collect: personal information, professional information, social media information, location information, banking and billing information, and/or contact information.

 

DELUXUS will only have access to the information provided by the User personally and directly, through electronic means such as email, the Platform, social media, or other existing direct or remote contact methods.

 

8. Purpose

 

DELUXUS will only request Personal Data that are consistent with the purpose of the Website.

 

The Personal Data required when creating a user account will be used to:

(i) Incorporate them into the necessary legal documents to formalize the contracted professional services; (ii) use them in any judicial and/or extrajudicial collection process; (iii) generate statistics and reports on the data provided by the Applicant to keep track and monitor them; (iv) prevent and/or report crimes, offenses, or irregularities related to the contracted services; (v) comply with the acquired contractual obligations; (vi) manage and operate the requested or contracted services; (vii) evaluate the capabilities, knowledge, skills, training, and professional titles of the Applicant; (viii) report crimes, offenses, or irregularities related to the Applicants; (ix) improve the content of the Website, facilitate access to services, and personalize the User experience; (x) continue with the Applicant evaluation process using the contact means provided in the application form; (xi) send information for advertising, marketing, and research purposes.

9. Confidentiality and Transfer of Personal Data

 

The Personal Data collected are entirely confidential, and DELUXUS will implement security measures to prevent their unauthorized use.

 

DELUXUS will not disclose the Personal Data of Users or Applicants, except in the following cases, following a dissociation process:

  • DELUXUS may share personal information with other controlling or controlled entities, subsidiaries, or affiliates, which will use the information consistently with the purposes for which the Personal Data were collected and with the consent granted by the User.
  • DELUXUS may also share the Personal Data of Users with third parties interested in hiring the services of the Applicant. These third parties may only use the User's Personal Data to evaluate the profile of the Applicant for hiring purposes and must treat such information strictly confidentially.
  • In specific and limited circumstances, DELUXUS may share or transfer Personal Data to unrelated third parties. For example, if requested by the User, to comply with legal obligations or requirements of state or judicial entities, to investigate crimes such as identity theft, in the context of sale, purchase, merger, reorganization, liquidation, or dissolution of DELUXUS or a business unit of DELUXUS, or if the information is in the public domain.

10. Data Storage

 

DELUXUS will retain the User's Personal Data for the time necessary to fulfill the purposes outlined in this Privacy Policy. The collected Personal Data will be deleted when they are no longer necessary or relevant for the purposes for which they were collected, unless there is a legal obligation to retain them for a longer period, or in case of exercise of ARCO rights (as defined below) by the User.

 

11. ARCO Rights of the Data Subject

 

In accordance with the Data Protection Law, the Data Subject has the following rights regarding their Personal Data, known as "ARCO Rights": the right to access their Personal Data, the right to request its rectification or deletion, the right to request the cancellation of its processing, the right to request the limitation of data processing, the right to data portability, and the right to file a complaint with a supervisory authority.

 

The Data Subject can exercise their ARCO Rights, including access, rectification, cancellation, or opposition to the processing of their Personal Data, as well as revoke any consent granted, through a procedure established for this purpose.

 

If the Data Subject has granted consent for a specific purpose, they have the right to withdraw that consent at any time, without affecting the legality of the processing based on the consent given before its withdrawal.

 

12. Procedure for Exercising ARCO Rights

The Data Subject's full name and email address or another contact method to receive the response.

A simple copy of documents verifying the Data Subject's identity, or if applicable, a power of attorney or document proving legal representation.

A clear and precise description of the Data Subject's Personal Data and the rights they wish to exercise.

 

DELUXUS will respond to the request within a maximum period of 20 (twenty) business days from its receipt. If the request is granted, it will be carried out within the following 15 (fifteen) business days from the communication of the response. These deadlines may be extended once for an equal period if circumstances justify it.

 

If the Data Subject believes that their rights regarding the protection of Personal Data have been violated, they have the right to file a complaint with the relevant authority, which in this case is the National Authority for Personal Data Protection - ANPD - of the Peruvian State Platform.
